8. Consideration of Division of Safety of Dams Enforcement Regulations (Action Item)

The Department of Water Resources’s (DWR’s) Division of Safety of Dams (DSOD) developed proposed regulations to impose administrative civil penalties, punitive reservoir restrictions, and other actions to ensure compliance with California’s Dam Safety Program. The Commission approved the regulations for submission to the Office of Administrative Law (OAL) on October 21, 2021. DWR submitted the regulations for final approval from OAL, but subsequently withdrew them. DSOD made modifications, and published the notice of the modified proposed regulations for public comment on June 20, 2022.  Written comments on the modified proposed regulations are due by July 2, 2022 or may be submitted at the meeting.  DSOD staff will present the modified proposed regulations for Commission approval, pursuant to California Water Code section 161.

9. Six-Year Drought: California Droughts of the Past, Present, and Future Expert Panel

In support of Water Resilience Portfolio Action 26.3, a panel of experts will present climate science, water management, and water policy perspectives on droughts in California.

10. Water Storage Investment Program: Request to Increase Early Funding Award Amount (Action Item)

In February 2022, the Commission voted to adjust the Maximum Conditional Eligibility Determinations (MCEDs) of all projects in the Water Storage Investment Program (WSIP) to account for inflation. WSIP projects may receive up to 5% of a project’s MCED as an early funding award to pay for completion of environmental documentation and permits. The Commission will consider a request from Southern California Water Bank Authority, project proponent for the Willow Springs Water Bank Conjunctive Use Project, to increase its early funding award amount as a result of its increased MCED to 5% of the adjusted MCED.

11. Water Storage Investment Program: Road to Final Funding

Commission staff will present an overview of the Water Storage Investment Program’s remaining process from the present through projects’ final award hearings.
