WSIP Notice of Proposed Rulemaking

The California Water Commission on November 19, 2025, approved modifying its Water Storage Investment Program (WSIP) regulations using the emergency rulemaking process. The modification would allow the Commission to increase the amount of conditional funding committed to a project on a case-by-case basis, to account for inflation and increased public benefits.

Commission staff will file the proposed emergency rulemaking action with the Office of Administrative Law (OAL) on or about December 1, 2025. As part of its rulemaking package, Commission staff will also send any written comments received to OAL. Once received, OAL will publish a notice of submission on its website, and the public comment period (available under OAL’s emergency regulation review process) opens. The public has five calendar days (from the date the notice is published on OAL’s website) to submit written comments on the Commission’s proposed emergency regulation to OAL.

OAL will only consider a public comment if, and only if, it meets the following four criteria:

The comment is submitted to OAL in writing (i.e., no verbal comments);
The comment is received during the open comment period (i.e., within 5 calendar days after OAL posts the notice on its website);
The comment notes that it relates to an emergency topic and identifies this proposed emergency rulemaking action from the Commission; and
OAL confirms the Commission received the comment.
